Limitation of liability for internal content
The content of our website has been compiled with meticulous care and to the best of our knowledge. However, we cannot assume any liability for the up-to-dateness, completeness or accuracy of any of the pages. Pursuant to section 7, para. 1 of the TMG (Telemediengesetz – Tele Media Act by German law), we as service providers are liable for our own content on these pages in accordance with general laws. However, pursuant to sections 8 to 10 of the TMG, we as service providers are not under obligation to monitor external information provided or stored on our website. Once we have become aware of a specific infringement of the law, we will immediately remove the content in question. Any liability concerning this matter can only be assumed from the point in time at which the infringement becomes known to us.

Limitation of liability for external links
Our website contains links to the websites of third parties (“external links”). As the content of these websites is not under our control, we cannot assume any liability for such external content. In all cases, the provider of information of the linked websites is liable for the content and accuracy of the information provided. At the point in time when the links were placed, no infringements of the law were recognisable to us. As soon as an infringement of the law becomes known to us, we will immediately remove the link in question.

The content and works published on this website are governed by the copyright laws of Germany. Any duplication, processing, distribution or any form of utilisation beyond the scope of copyright law shall require the prior written consent of the author or authors in question.

Data Privacy

To be able to provide you with our services we, as well as external service providers, are processing personal data (“data” further on) collected on this website. Further on we list the purpose of our data processing and external service providers, to show transparently and clear how and where your data is being processed, as well as how you can refuse the processing.

You can get insight into, change or delete the processed data concerning you at any time. In order to do so please contact dataprivacy[at]crowd-literature.eu. They will get back to you within 72 hours. Alternatively you can also contact the individual external service providers, insofar they are processing the data that concerns you, in order to get insight into, change or delete your data.

We reserve the right to change the content of this data privacy statement without prior notification, in order to comply with the statutory guidelines.

To the individual purposes of data processing

1. Hosting and E-Mail

Our website is hosted with the German service provider webgo GmbH, Wandsbeker Zollstr. 95, 22041 Hamburg. When visiting our website the following data is processed in server log files: your IP-address, the accessed file or link, the time of your access, your browser and your operating system. The data is processed on the basis of our legitimate interest according to Article 6 Paragraph 1 of the GDPR, for the purpose of safety and troubleshooting. The data is deleted after maximally 7 days. Data that has to be preserved as evidence in cases of malpractice or fraud will be saved until the incident is resolved. The tools “Webalizer” and “awstats”, web-analysis software for statistical utilization of user traffic, also use the log files to provide an anonymous overview of website traffic.

The server used also saves mail log files that contain each e-mail received or sent from the server. The log files do not contain the content of the e-mails, but the IP-address of each server, as well as the sender and recipient e-mail address. The data is either deleted or made anonymous after four weeks.

2. Newsletter

CROWD sometimes uses a newsletter to spread information. For that we use Mailchimp, a newsletter platform of the:

By using the Rocket Science Group we are transmitting your data to a country where data processing isn’t governed through the GDPR, however the service provider has the needed certificates (EU-US Privacy Shield) that show it upholds to the EU data privacy standards. Mailchimp can use your data in a pseudonym form (without it being possible to assign the data to a specific person) to improve its own services, however Mailchimp cannot use your data to contact you directly or provide others with your data.

2.1. Signing up:

For signing up new members to our newsletter we use the GDPR conforming double-opt-in procedure. This means: before you can subscribe to our newsletter you will first receive an e-mail, asking you to confirm your subscription. This allows to check if it was really you that subscribed to the newsletter. When you subscribe the IP-address, sign-up and conformation time stamp will be saved. If you would want to change your data at a later time, the change will be automatically saved as well as logged.

If entered we also save your name together with your e-mail address for the purpose of a more personalized communication. The processing of the data entered in the sign-up form is based solely on your agreement (Art. 6 Par. 1 lit. a DSGVO). The data you provided for the purpose of receiving our newsletter will be saved until you express a wish to be removed from the subscribers’ list or do so yourself. The data saved for other purposes (i.e. e-mail addresses of association members) are not affected by this.

2.2. Unsubscribing:

You can withdraw your agreement at any time and effectively canceling your subscription to the newsletter. You can do so by using the unsubscribe link at the end of each newsletter, or by contacting us at info [at] crowd-literature.eu . The legitimacy of the data processing prior to your cancellation will not be affected.

2.3. Traffic analysis

To optimize our communication with you our newsletters contain a “web-beacon”. This means that when opening the newsletter information about your browser, operating system, IP-address and the time of when you opened the newsletter will be saved. This information helps us to identify your reading habits (was the newsletter opened, when, what links were clicked on…) and devices used to access the newsletter, so that we can create the newsletter in a way that is tailored more to your habits and prefferences.

3. Contact

When taking up contact (be it via contact form, e-mail, telephone or social media) your information will be processed for the purpose of your inquiry. Your message will be saved in the e-mail communication. If your inquiry should lead to a cooperation or a customer relationship, we reserve it to use the already obtained data for this purpose (cooperation agreement, invoices, contracts…).

When using the contact form your inquiry will be saved in the back-end area of our WordPress installation, as well as forwarded to our e-mail address. As soon as your inquiry is not relevant anymore, the data will be deleted, unless dictated otherwise by the obligation to preserve records.

4. Visiting our website

4.1. Analysis software Jetpack for statistical data utilization
To optimize the content of our website we use the WordPress plugin Jetpack for statistical data utilization. This is provided by:

The service provider is obliged by the EU-US Privacy-Shield certificate, to uphold the necessary technical requirements for a data transfer up to standard with the GDPR.

IP address, WordPress.com user ID (if logged in), WordPress.com username (if logged in), user agent, visiting URL, referring URL, timestamp of event, browser language, country code. Important: The site owner does not have access to any of this information via this feature. For example, a site owner can see that a specific post has 285 views, but he/she cannot see which specific users/accounts viewed that post. Stats logs — containing visitor IP addresses and WordPress.com usernames (if available) — are retained by Automattic for 28 days and are used for the sole purpose of powering this feature.

4.2. Embedded content from other websites

Posts on our website can contain content from others (videos, photos, text…) Embedded content from other websites behave exactly as if you’d visit the individual website.

This means: these websites can collect data about you, use cookies and embed additional tracking services from external service providers, and record your interaction with the embedded content, if you have an account and are logged in at the specific website.

4.2.1. SOUNDCLOUD

Audiodata is uploaded and embedded through the platform Soundcloud:

Audiodata saved at Soundcloud is embedded through a software, that enables you to play the audio in your browser. When playing the data Soundcloud can measure which data are listen do in what capacity and process the data in a pseudonym form for statistical and business assessment purposes.

As CROWD we are present on the social media Facebook, Twitter and Instagram, to communicate with active users and inform them about our events and development. If you visit us on these social media the same data privacy and terms of use apply as stated on the individual websites.

If users of these social media communicate with us – either through publicly visible interaction or posts or through private communication – we process their data unless otherwise stated within our data privacy.
